A U.S. district court judge has granted the Entertainment Software Association a preliminary injunction in its case against the Chicago Transit Authority, the ESA said Friday.
The CTA issued an ordinance in January 2009 that prohibited any ad that "markets or identifies a video or computer game rated ‘Mature 17+’ (M) or ‘Adults Only 18+’ (AO)." Judge Rebecca Pallmeyer said in her opinion that "the advertisements the CTA wishes to ban promote expression that has constitutional value and implicates core First Amendment concerns."
"It is our hope that the CTA sees the futility of pursuing this case further. To do so will waste taxpayer money and government resources," said ESA president Michael Gallagher in a statement.
The case stems from an incident in August 2008 when the CTA pulled a series of potentially offensive Grand Theft Auto IV ads from the sides of city buses and trains.
