A couple of accused file-sharers in Denmark got out of a legal jam with a tight defense -- and it worked. The accused music pirates argued that the files that were illegally obtained were downloaded by WiFi thieves, according to TorrentFreak.
It was an effective defense because the burden of proof rests on the plaintiff and not the defendant, according to a lawyer quoted in the reports.
"Many who have received letters with claims have been given the impression that they were required to pay. But we now have the court’s word for that, they do not [have to pay]. It is not enough to say that you are guilty of piracy due to owning a particular Internet access point," a lawyer representing the defendants reportedly said.
