Have you heard that an Italian court ruled this year that not-for-profit file sharing is legal? If you have, you heard wrong.

Stanford's ever-vigilant Center for Internet and Society (a great site for IP) reports that, although two students were acquitted for file sharing because they did not "profit," this case was decided based on law as it was when the charges were levied, in 2000.

At that time, file sharing that did not generate profit was not a criminal offense, but the term "profit" was quickly updated to include personal use as a profitable venture.

So, no matter what you hear, file sharing is not legal in Italy.

By the way, the decision was rendered by Italy's Corte di Cassazione; I just wanted to say that.
