The Supreme Court discussed Reno v. ACLU in its morning session Wednesday but hasn't decided whether it will hear the case or reaffirm a lower court's ruling that the Communications Decency Act is unconstitutional.
Further discussion wasn't on the high court's agenda for next week, the court clerk's office said.
In June, a federal court in Philadelphia unanimously ruled that the CDA would unconstitutionally restrict speech on the Internet. The three-judge panel granted a preliminary injunction against the act, and the government quickly filed an appeal to the Supreme Court.
The clerk's office said the court will likely decide before year's end whether to hear the case. It will also decide whether to fold a separate suit filed by online newspaper editor Joseph P. Shea into the ACLU case.
